GENERAL SUMMARY:

The Senior Tax Manager will report into the Director of International Tax for the Asia Pacific and Japan (APJ) region, with matrix reporting to the Senior Finance Director at the COE. The Senior Tax Manager will be an integral part of the local Finance Leadership team and will be responsible for all direct and indirect tax matters in India (compliance, planning, forecasting, audit defense, reporting and accounting). While the main country of focus is India, there will be a significant overlap with the APJ, EMEA and US regions and their associated tax matters.

PRINCIPAL DUTIES AND RESPONSIBILITIES:

- Primary point of contact for all local tax issues raised by the COE team; provide tax advice, guidance and solutions.

- Partner with business leaders, tax, finance, treasury, legal and external advisors on various business and tax planning matters.

- Identify, recommend and implement tax-efficient models for the Indian operations.

- Advise and support on the implementation and execution of local integrations (mergers, demergers, slump sales) and rationalization/liquidation of dormant entities.

- Manage transfer pricing requirements including analysis, policy implementation and maintenance of supporting documentation.

- Review direct and indirect tax payments and return filings including income tax, VAT, Service Tax and SEZ.

- Manage tax audits and assessments with the Revenue authorities; prepare and file appeals; make written and oral submissions to the various bodies; develop and implement strategies to minimize tax costs.

- Provide advice and support on SEZ-related matters and requirements to include obtaining SEZ unit approvals and the expansion of existing SEZ units.

- Assist with US tax return compliance for India including US tax informational reports (Forms 5471, 8858) for local entities.

- Assist in ASC 740 reporting for Indian activities, including reconciliation and true-up to financials.

- Review and finalize local subsidiaries- quarterly tax provision in accordance with ASC 740.

- Participate in the development of systems and processes that continuously improve tax compliance and reporting processes.

- Research and advise business divisions and local finance teams on intercompany remittances, settlements and withholding tax requirements for cross-border transactions involving multiple tax jurisdictions.

- Assist in international tax planning, including Subpart F minimization, cash repatriation, intercompany funding, foreign tax credit utilization and ETR forecasting.

- Identify and quantify tax exposures and recommend mitigating actions.

- Advise on tax aspects of mobile employees including deputation and secondment cases.

- Liaise with local authorities in relation to incentive packages and make written and oral submissions before the authorities.

- Provide education and training to local teams on tax policies and protocols.

- Research complex tax issues and prepare technical documentation.

- Manage external tax advisors.

EDUCATION REQUIRED :

- Strong academic background.

- Bachelor or Master Degree in Commerce, Finance, Accounting or Law.

- Professional qualification (Chartered Accountant or equivalent).

EXPERIENCE REQUIRED:

- Extensive (ideally 10+ years) Indian and international tax experience.

- Big 4 accounting firm background preferred.

- IT Industry/MNC experience a distinct advantage.

- Hands-on experience of India's SEZ, STPI and associated regimes.

- Understanding and experience in Company Law, Exchange Control and other regulatory matters.

- In-depth knowledge and experience of diverse tax matters to include:

Compliance; Planning; Forecasting and Reporting; Holding, Financing and Intellectual Property Structures/Regimes; VAT and Service Taxes; M&A, Restructuring and Reorganization; Transfer Pricing; Tax Audit Defense and Dispute Resolution; Tax Accounting incl. ASC740, FAS109 and FIN48; US Tax Concepts, Principles and Planning incl. Subpart F.
