Responsibilities:
- Real Estate (Regulation and Development) Act (RERA): Advise clients on all aspects of RERA compliance, including registration of projects, drafting and reviewing agreements for sale, handling RERA complaints and representing clients before RERA authorities.
- Transfer of Property Act: Handle all aspects of property transfers, including conducting due diligence, drafting conveyance deeds, sale agreements, gift deeds, and other related documents, and ensuring smooth registration of properties.
- Contract Act: Draft, review, and negotiate various real estate contracts, including purchase agreements, lease agreements, joint venture agreements, development agreements, and construction contracts.
- Ensure compliance with the Indian Contract Act and protect client interests.
- Consumer Protection Act: Advise clients on consumer rights and obligations in real estate transactions.
- Represent clients in consumer disputes related to real estate projects and transactions.
- State Rules and Regulations: Stay updated and ensure compliance with relevant state-specific rules and regulations related to real estate, including land revenue codes, building regulations, and other local laws.
- This will involve understanding nuances in different state jurisdictions.
- Due Diligence: Conduct thorough due diligence of properties, including title searches, verification of approvals and permits, and assessment of potential risks.
- Legal Research: Conduct legal research on complex real estate issues and provide well-reasoned legal advice to clients.
- Client Management: Build and maintain strong relationships with clients, understand their needs, and provide timely and effective legal solutions.
- Litigation : Represent clients in real estate litigation matters, including property disputes, title disputes, and contractual disputes, before various courts and tribunals.
- Documentation: Prepare and maintain accurate and organized files and records related to real estate transactions.
- Negotiation: Negotiate effectively with opposing counsel and other parties involved in real estate transactions.
- Stay Updated: Continuously update knowledge of real estate laws and regulations through professional development activities.
Qualifications:
- LLB degree from a recognized university.
- Enrollment with the Bar Council.
- Strong understanding of real estate laws and regulations, including RERA, Transfer of Property Act, Contract Act, Consumer Protection Act, and relevant State Rules and Regulations.
- Excellent research, analytical, and problem-solving skills.
- Excellent drafting and communication skills (both written and oral).
- Ability to work independently and as part of a team.
- Strong client management skills.
- Attention to detail and organizational skills.
- Proficiency in MS Office Suite.
Preferred Skills (Optional):
Experience in a specific area of real estate law (e.g , land acquisition, development, leasing).
Familiarity with legal databases and research tools.
Experience in handling high-value real estate transactions
