Litigation Head
Responsibilities:
- Contributes to the business's strategy and decision making processes alongside other departmental leaders.
- Assessment of known and anticipated risk to the organization.
- Create and implement legal strategy to respond to and / or mitigate such risks.
- Examining Title Search & Due Diligence reports & Advising title examiners to clear exceptions and support Business.
- Corporate and legal documents and ensuring the same to be as per organization's standards and policies.
- Notices, replies, petitions, Writs, Written Statements, MOU, Settlement Terms, Application etc. also
- Sensitive and high-stake legal documentation necessary for business operations.
- Applicable statutory laws and local ordinances (stamp duty/ registration etc.) to ensure strict compliance.
- Mentoring & Training legal and collection departments personnel, encouraging their professional growth, and grooming them for future.
- Ensuring free circulation of information on relevant laws and policies across the business.
- Tailor made training modules on legal issues affecting individual departmental activities and transactions.
- Part of various organizational committees for ensuring proper redresseal of employment matters.
- Handling high value fraud cases / delinquent clients and ensuring initiation of legal actions as per policy timelines eg. Complaints U/s 138 of NI Act, Section7/19, Arbitration Cases, Criminal cases,
- Execution proceedings and other innovative legal tools for recovery.
- Formulate and implement policies/ processes with the goal of early resolution of cases without expensive litigation.
- Facilitating win-win resolution by negotiating complex collection matters & business disputes.
- Reforming & developing the procedures/MIS for Gap Analysis.
- Ensuring frequent flow of updated legal information to branch offices & Implementation of Tailor-Made Cost-Effective Process
- Improvement Strategies/Action Plans.
- Ownership of the entire litigation portfolio of the organization.
- Determine and engage appropriate litigation counsel and provide direction during all phases of litigation before Courts/
- Forums/Tribunals and various other judicial/ quasi-judicial/ regulatory authorities.
