Job Description
Key Responsibilities:
- Study the legal profile of stressed financial assets (loans, advances etc.) available for acquisition from banks or institutions and determine the acceptability of the asset from the perspective of documentation, security creation, title validity, limitation and other legal factors affecting realisability.
- Prepare, review and modify from time to time the legal documentation relating to acquisition of financial assets and restructuring of acquired assets.
- Post-acquisition, ensure appropriate and speedy registration of agreements and modification of charges as applicable and compliance with other statutory requirements.
- Draft, modify or approve as necessary, appeals, notices, petitions, applications and other related papers in the context of initiating, continuing or defending proceedings under/before SARFAESI, DRT/DRAT, Company Court/DM, Revenue Authorities and other legal fora
- Be present along with Company's counsel during important hearings in the Courts/Tribunals.
- Identify, appoint with necessary approval and monitor the effective functioning of advocates at various centers.
- Interact appropriately with various functionaries including Official Liquidators, Receivers etc.
- Render in-house advice on effective and speedy recovery of advances through legal processes.
- Render in-house support on other legal matters and documentation.
