Legal Manager - IPR - Brand Protection & Trade Marks - FMCG

We are currently looking for a LEGAL MANAGER (IPR)- BRAND PROTECTION & TRADE MARKS position with the topmost fortune 50 MNC in India. The position is to be based at their Regional Offices in Mumbai & Chennai

- Job Purpose – To Build up deterrence in the counterfeit trade through legal machinery and other organisational strategies relating to IPR matters & contracts

- Role – management and coordination of anti-counterfeit campaign in the region and handling other IPR matters including contracts.

Job Responsibilities:

1. Liaising with the sales force and motivating / educating them on the importance of sending sighting reports, preferably with samples purchased.

2. Studying and analyzing the QC Reports.

3. Liaising and managing third party investigations and reviewing their reports.

4. Organizing for sample purchase, sending to lab/QC for analysis and ensuring receipt of the same in their regions.

5. Instructing lawyers and checking/authenticating facts and figures in the legal documentation.

6. Organizing logistics for raids including manpower, transport, storage etc., within budgets.

7. Attending raids to assist its execution as a company representative.

8. Representing the company as a complainant in criminal proceedings and consequent judicial proceedings.

9. Ensuring timely submission of REPORTS as per guidelines and formats in vogue.

10. Conducting investigations in the market, picking up spurious samples and creating evidence against counterfeiters.

11. Understanding markets and adapting TMO activities to market requirements and evolving a proper post raid strategy.

12. Interacting and convincing senior level police/enforcement officers & also interacting with field level officers to conduct actions on counterfeiters/ infringers.

13. Implementing and ensuring compliance like company policies relating ethics, security, environment and safety.

14. Managing and Supporting business of IP related contract matters.

Education:

LL.B. or any other equivalent degree in Indian Laws or at least 5 years of working experience of law enforcement work.

Experience:

- 3-4 Years of court related experience

The following would be preferable though not essential

- Strong law enforcement background like CBI, CID, or Defence/Army background.

- Good Knowledge of Intellectual Property Rights and related Laws

- Good understanding of Civil & Criminal procedural laws

Location: 2 positions exist- one each at Mumbai and Chennai
