As Head Legal & Foreclosure, you will be responsible for managing the complete SARFAESI process right from sending out of S13(2) notice' to the auction of the property a unique service proposition offered by none in the financial services industry.

What you will do:

- Managing legal and foreclosure vertical litigation & non-litigation

- Managing internal and external relationships and forge new partnerships both within and outside the organization to build business depth & scalability.

- Working closely with clients (Banks/NBFC/FIs) and legal channel partners (Law Firms) to ensure deliverables as per defined SLAs.

- Understanding of financing/lending set of documents in Secured and Unsecured Finance and then initiating litigation for recovery of dues with adept understanding in Commercial Laws.

- Litigating the work - invoking Arbitration/DRT/S138/Summary Suit/IBC OR initiating enforcement of security under SARFAESI.

- Issuing demand notices under SARFAESI replies notices and issuing miscellaneous notices as per Security Interest Rules as advised by the client / legal channel partners.

- Adopting with Insolvency and Bankruptcy Code and all its Regulations for procedures to be followed before Resolution Professional and NCLT including the filing of relevant applications.

- Attending COC meetings and briefing the concerned stakeholders accordingly.

- Ground-level understanding of the enforcement process to aid faster resolution under SARFAESI.

- Handling of Criminal matters before Magistrate/Sessions/High Court including the filing of FIR/Complaint before Police/Magistrate respectively.

- Overseeing inward & outward invoice and billing timelines

- Understanding all Legal aspects related to lending business to SMEs / MMEs / Large Corporates.

Candidate Profile:

What you need to have:

- Min exp of 8 yrs in litigation & commercial law.

- Working and Practical Knowledge of SARFAESI from the issue of 13(2) notice till final Auction of property.

- Well versed in banking, financial and corporate laws like RBI Guidelines with respect to the organization's business, Companies Act, Contract Act, Arbitration Act, Regulatory Laws.

- Adept in handling any other nature of litigation as the situation arises.

- Broad understanding of Insolvency & Bankruptcy Code

- Should have adequate knowledge of the Sarfaesi Act, DRT Proceedings, Legal Operations & Litigation.

- Updated on new policies, laws and judgments and preparing notes and circulating for the benefit of stakeholders.

Experience: 7 to 10 years
