Organization: Justice And Care  Job Title: Director Legal  Reports To: Senior Director Legal  Location: Mumbai/ Delhi/ Bangalore/ Kolkata  Introduction :  United Nations defines trafficking as - the recruitment, transportation, transfer, harboring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation- . Today, people are trafficked within and across international borders to be exploited in domestic servitude, forced labor in the manufacturing industry, the sex trade, adoption, forced marriages and other kinds of slavery.  Justice and Care works to address these areas of human trafficking. They work internationally with governments and law enforcement agencies, focusing on prevention, protection and prosecution.   Justice and Care started in 2008 in India and currently has offices in UK (Scotland), USA, Netherlands, Nepal, Bangladesh (Most offices including Netherlands, US, UK have both Fundraising and operations as well). In India, there are offices in Bangalore, Mumbai, Kolkata, Delhi and also very recently in Bihar.   The objective of the organization is saving lives and breaking the cycle of crime. They work across the entire spectrum of the trafficking including prevention, rescue, working with law enforcement and judiciary in neutralizing the criminal nexus, rehabilitation and policy advocacy.  Strategy :  Years of working with and for victims of human trafficking resulted in the development of an end to end strategy .   The strategy focuses on the source areas, transit points and destination areas.  - Missing Person's Program  - Destination Intervention Program  - Transit Surveillance Program  - Community Intervention Program  - Care and Protection Program  Reason for Hire :  The current Director- Legal is taking on a higher position within the organization. Against this backdrop, the organization is seeking to hire a dynamic and experienced individual to take on that role. The ideal incumbent would come in with expertise in litigation and a strong understanding of advocacy and legal frameworks. The Director- Legal should have the ability to visualize long term strategy for the organization and align short term goals to that.   Responsibilities and Results :  Strategic Leadership & Management :   - Provide strategic leadership as a member of the senior management team.  - Supervising the activities of the legal team across India & South Asia.  - Assist in monitoring and evaluation of Legal Teams and their work in conjunction with all disciplines at Justice and Care to ensure excellence.  Litigation/ Legal Oversight :   - The incumbent is responsible for resolving disputes in the court system by framing strategies and is also in charge for undertaking litigation work.  - Representing and supervising Justice and Care in criminal and civil court proceedings across India and South Asia.  - Providing legal advice to Justice and Care in the areas of criminal law and procedure, evidence, trial practice, civil procedure, constitutional law, administrative law and regulatory law.  - Drafting legal documents wherever required as well as supervising the drafting of legal documents by the various advocates and legal counsels representing Justice and Care in criminal and civil proceedings across India & South Asia.  - Negotiating and formalizing of MOU's (Memorandum of Understanding), Agreements and Partnerships.  - Licensing of, Registration of, and the formalizing of other similar processes for Shelter Homes, Aftercare Homes, Rehabilitation Homes, Reintegration Homes and other similar Homes.  Networking :   - Participate in partnership meetings and influence government power actors and civil society agencies to work with Justice and Care to end trafficking.  - Networking and working closely with the Government and special public prosecutors on behalf of the victims.  Research and Training :   - Supervising legal Research including online research on various law related topics and preparation of legal memos   - Conduct as well as assist in Training with staff and Government and external stakeholders on laws, acts, ordinances, notifications, procedures, methodology, etc.  Must Haves :  - A Bachelors Degree in Law (LLB) and a Post Graduate degree in a relevant discipline with minimum 10 to 12 years of experience, out of which a majority of the experience should be in the areas of criminal law.  - Prior experience in advising clients on legal cases or transactions with in depth knowledge of laws, legal codes, court procedures, precedents, government regulations, executive orders, agency rules, and the democratic political process.  - Strong leadership, management, analytical, negotiation, and relationship building skills.  - Proven experience of developing, negotiating and agreeing influencing strategies with Government and external stakeholders.  - Experience in conducting research and advocacy  Preferable :  - Demonstrated success in fighting and building legal cases.  - Excellent communication skills, both written and oral.  Location : Mumbai/ Delhi/Bangalore/Kolkata  Third Sector Partners, a leading senior management and board search firm in the Not for Profit sector has been retained for this position.
