Experience: 2-4 years

- Position is for Kochi so candidate willing to relocate or candidate from Kochi to be considered

- Should be available for interview in Chennai

- Proficiency in Malayalam can be helpful

Purpose of the role :

- To manage conflicts between parties of diverse interests & provide quicker remedies for queries & disputes within regulatory framework.

- To process arbitration applications received by investors and trading member and adherence to TAT as per SLAs. To prepare MIS & reports for internal use, committees, regulators & website. To interact with other internal departments.

- Issue NOC for all trading members and handle queries from regulators on cases arbitrated in the past.

Key Responsibility :

- Descriptive Parameters

- Investor complaint redressal process

- Register investor complaints after validation.

- Analyse the complaint & take up issues with Trading Member / Company.

- Hold meetings between parties.

- Arrive at resolution of issues.

- Provide trade data to investors.

- Co-ordinate with regional offices for complaints.

- Support with Activities pertaining to blocking of deposits of trading members.

Arbitration Applications :

- Verify the application and documents submitted for arbitration of an investor complaint, so as to Admit/ Register the arbitration case if found relevant.

- Send the documents to the respondent (member) asking for his response (statement of defence/ counter claim) to the complaint filed by the applicant (investor).

- Send the arbitrator list to the respondent and applicant asking them to choose their preferred arbitrators.

- Send letter to the preferred arbitrator asking for his confirmation to the matter; Reiterate the process of choosing arbitrators if the arbitrator chosen declines to conduct the process.

- Intimate the applicant and the respondent about the arbitrator chosen and hearing date.

- Coordinate the hearing(s) for the arbitration till the case is closed/ adjourned with an award from the arbitrator.

- Send the award files to both parties and ensure that it is acted upon.

- Block/release the money of the trading member according to the award after taking manager's approval.

- Reiterate the whole arbitration process with new arbitrator if any of the party has filed Appellate.

- The aggrieved party can take the case to the court even after the arbitration appellate mechanism.

- Release the payment for the trading member if he does not get a stay within 90 days of the case going to the court.

- Upload the details of the case and awards on the website.

Committee meetings :

- Execute various tasks related to Regional Investor Complaint

- Undertake action recommended by IGRP members.

- Execute various tasks related to Investor Services Committee (ISC).

Implementation of award :

- Debit/block the award amount from the deposits of the member In case the award is in favour of investor

- Convert the award amount into FDR in case appeal is filed before the appellate arbitrators of the Exchange or before the court of competent jurisdiction

- Prepare cheque for the amount debited in name of investor in case member fails to file appeal before the appellate arbitrators of the Exchange or before the court of competent jurisdiction

- Coordinate with members, and wait for court order in case member files petition

- Support court order so as to implement/reject award as per court order.

- Send FDR to bank for encashment and prepare cheque so as to forward cheque to the respective member.

MIS & status updates :

- Send weekly MIS containing details of all complaints and their outcomes to the HOD for internal records and analysis.

- Send these reports to the respective regions.

Investor Interaction & Handling queries :

- Respond to queries of investors as well as Regulators.

- Forward specific queries to the respective departments (like trading).

- Draft the report in response to the queries raised by regulators like SEBI/ EOW/ MOF/ Police regarding cases that have been arbitrated before.

Issue No Objection Certificates for members :

- Handle all tasks related to issuing NOC.

- Issue NOC for members to confirm that they do not have any arbitration pending against them, on being intimated by membership department.
