Job/Role Title: AGM

Function/Department: Corporate Strategy - Trade Protection

Location: Gurgaon

Job Purpose:

- Analyze data and collect market intelligence on competitors' business practices for representation/interface with concerned authorities for suitable action, aligning them with the law.

- Provide support in curbing activities related to Tariff and Non-Tariff Barriers, including Countervailing Duty, Circumventing Anti-Dumping Duty, Basic Custom Duty (FTA), and BIS through Customs CBIC and Field Formation.

- Coordinate with NAC, FAG, SIIB, CRU, DRI, Preventive, DGOV, PCA, Anti Evasion, DGGI, all Customs & GST investigating authorities to create conditions of free and fair competition in the Indian market.

Policy Framework:

- Knowledge of Customs & GST Act and Rules, Policies, Notifications, Circulars, HSN classification, E-way bills, Under-invoicing, Custom valuation rules, Advance License Procedures.

- Sound knowledge of Customs Rules and Regulations related to trade remedies - Free Trade Agreement (CAROTAR RULES).

- Capable of timely presentation of various issues to CBIC, Customs, GST file formation, and various investigating agencies.

- Customs/GST Interface (Including Ports, ICD's CBIC, etc.):

- Analyze monthly import data and take up specific cases of circumvention to relevant Customs and GST Authorities to ensure the correct duty is levied.

- Highlight cases of the misuse of FTA - CAROTAR after analyzing import data and request customs for provisional assessment.

- Visit ICDs and Ports to get Quality Control Order/BIS implemented.

- Visit various ports/ICDs to educate and sensitize Custom Authorities on possible areas and ways & means of circumvention of import duty and request for the duty.

- Follow up with Custom Authorities to ensure all relevant Tariff and Non-Tariff measures are implemented to curb imports, especially from China.

- Ensure SCN's and Adjudication Orders in various cases of importers evading Customs and GST duty.

- Highlight cases of APTA misuse and correct HSN/CTH to avoid paying lesser BCD of consignments from China.

- Issue SCN's in the case of FTA misuse and get the case transferred to respective ports/ICD SIIB/Regional DRI office for adjudication.

- Showcase misuse of FTA from ASEAN Countries Malaysia, Indonesia, Vietnam, and Thailand.

- Provide inputs on specific cases of circumvention, especially Chinese Routing material through ASEAN countries to DRI and ICD.

- Submit representations related to Tariff and Non-Tariff measures to various government authorities related to under-invoicing.

- Liaise with GST, DGGI, and Anti Evasion, Government authorities on duty evasion issues.

- Conduct physical visits for verifications to suspected import parties and GST locations and develop intelligence for necessary action.

- Demonstrate the capability to gather market intelligence on practices and highlight them to GST and Customs for appropriate action as per the law.

- Metal/Product Exposure (Technical):

Knowledge of Metal, especially Stainless steel/Steel, will be an added advantage.

Educational/Professional Qualification:

- CA or LLB - Indirect Tax -GST and Customs Work- Data Analytics.

Experience (Desirable):

Experience in Indirect Tax - Customs and GST Work, preferably with prior experience in understanding Tariff and Non-Tariff measures and firsthand dealing with customs after analyzing third-party data to stop circumvention and evasion of duty.

Competencies/Skills Required:

- Effective Communication: Written mail & letter writing and verbal with legal touch.

- Strong SAP Knowledge.

- Very Strong Advance Excel - Data Analysis and analytics - Capacity to handle large databases.

- Internal Department: Sales & GST.

- External Department: CBIC, Customs & GST, Consultant, Lawyer, and other investigating Government Officials.

- Soft skills/Tactful.

- Good Team Player.
